Online gaming has become extremely popular in India and has grown into a huge industry with millions of people spending billions of rupees on various games every year. It is also a major source of tax revenue for the government. However, the industry is largely unregulated, with little or no government oversight or legislation governing it. This basically means that people involved in online games, especially gamers, have little or no protection against online gaming platforms.

No matter what you think about online games, whether you think of them as a game of skill or a game of chance, the truth is that online games are addictive. There are several instances where online gaming addicts have gambled away their life savings on various games. Things take an even uglier turn when people die of suicide from online gaming and financial ruin.

Many online sports platforms, especially fantasy league platforms, are something we should look into as they reveal many tricks used by these platforms.

In their advertisements, they will often show a “real” customer, who originally came from a very humble background, and makes it big through the achievements made by the platform. Or a variant of the ad would be a person from a rural, very middle-class background who “wins” a high-end car.

The message is clear: If this guy can win that much, so can you. The kicker in all of this? All the heart-wrenching stories shown during these campaigns are scripted.

A very popular fantasy league platform ran a similar campaign and picked up the cricket star. The ad campaign was widely aired on TV as well as on YouTube during the IPL and other shows.

Also, this fantasy league app has gotten a lot of YouTube influencers to promote the app by using a 15-30 second ad in their videos. On an average, these YouTubers have about a million subscribers and an average of about 2 lakh views per video, which isn’t exactly huge.

What’s shocking is that for this campaign, every YouTuber with an average of 2-2.5 lakh views per video was paid 6-7 figures for a top-up. Crores were paid to cricketers and actors who promoted this app.

To push potential customers to the top and eventually sign them up, these platforms will run another series of profitable campaigns: new players will be issued small amounts of in-game currency, using which they will win as they play against bots. .

Or they will trick users into spending a rupee in the game to win an iPhone or some other prize. The moment a user spends their first rupee on such apps, the developers have broken the critical barrier to extort more money from them.

The fact that these games are designed to be addictive is a whole other story. From the initial rush to win that players feel in some of these betting games, to the way the user interface and animations are designed to magnify wins and losses, users lose all sense of perspective and reality.

These game apps also create a sense of sudden and false achievement. Because of this, players can play longer without interruption, pay higher commissions and enter more games and tournaments, all with their own real money involved.

A 29-year-old woman ended her life after losing 200 grams or 20 tolas worth of gold jewelery and her sisters’ money worth Rs 3 lakh in online gambling. During the lockdown, she is said to have become addicted to online gambling, due to which she mortgaged 20 tolas for a time, but lost money from online gambling. He borrowed Rs 1.5 lakh each from his two sisters to get the promised jewellery, but this amount too was lost.

In another incident, a 39-year-old woman committed suicide while her unemployed husband, who was addicted to online gaming, lost nearly Rs 20,000 to online rummy. That money is for his son’s school expenses.

These two were the first of many incidents that led the previous ADMK government in Tamil Nadu to completely ban online gambling. The decision was harsh and at best a knee-jerk reaction, but it showed a desperate need to regulate such sports. The Madras High Court later quashed the ban and asked them to come up with proper set of regulations instead of banning these games.

One of the biggest problems with the lack of regulation of online gaming in India is the possibility of cheating. As there are no clear rules or regulations governing the industry, players may be at risk of being scammed by unscrupulous individuals or companies.

For example, players may be promised prizes or rewards that never materialize, or they may be asked to pre-pay for a chance to participate in a game or tournament, which event does not take place.

In many cases, especially with offshore gaming platforms, the games were found to be corrupt. On many platforms, games like poker and rummy are played in such a way that new players have a better chance of winning, but only at the beginning. As they spend more and more time and money on these games, they start losing.

To keep these players engaged, these platforms’ algorithms ensure that they win a match or two when the player’s interest starts to wane.

It is imperative that online betting games and fantasy leagues legally appear to be games of skill rather than games of chance. However, the way these online games need to be positioned to the public is that anyone can win and more importantly win big.

Many online gaming platforms struggle to tread the fine line between actually pretending to be a game of skill and a game of chance.

On the one hand, these platforms want to be perceived not as a game of chance, but as a game that even the most novice players can win. This is the only way they can engage more players.

On the other hand, these sports must appear to be games of skill, otherwise they will be taxed at higher rates and subject to many other state regulations that govern how the state’s sports industry operates.

Gambling needs regulation, especially when players are prone to addiction and are at serious financial risk. The lack of regulation in the online gaming industry has led to serious consequences for individuals and families, especially in the Indian market itself. A proper set of regulations will go a long way to protect people from the dark side of online gaming.

However, more importantly, it will also benefit the industry. States and UTs in India where gambling is not only legal but regulated, such as Goa, Sikkim and Daman, prove that when the industry is regulated and not just taxed, it really thrives. Furthermore, online gambling regulations will help the industry grow exponentially and allay the fears of potential investors.
